1. Introduction

Welcome to Always In Motion. By accessing and using our website ("Site"), purchasing products, or otherwise engaging with us, you agree to comply with and be bound by these Terms of Service ("Terms"). These Terms govern your use of the Site and form a binding agreement between you and AIM: Always In Motion Limited ("we," "our," or "us").


If you do not agree with these Terms, please refrain from using our Site or making any purchases. We may amend these Terms at any time, and it is your responsibility to review them regularly.


Nothing in these Terms affects your statutory rights as a consumer.


 


 

2. Use of the Site

By accessing and using the Site, you represent that:


  • You are of legal age to enter into a binding contract, or you have the legal authority to act on behalf of a minor.

  • You agree not to use the Site for any unlawful purposes or any purposes prohibited by these Terms.

  • You will not engage in any conduct that disrupts or interferes with the functioning of the Site.


 


 

3. Accounts

You can browse and purchase from our Site as a guest without creating an account. You may also create an account to track orders and speed up future checkouts.


If you do create an account, you agree to provide accurate and complete information and are responsible for keeping your login details secure. Please notify us immediately if you suspect any unauthorised use of your account.


 


 

4. Orders and Payment

4.1 Order Acceptance and Cancellation When you place an order on the Site, you are offering to purchase products subject to these Terms. We reserve the right to accept or reject any order at our sole discretion, and we will notify you if we decide to reject an order. In the event of a rejection, you will receive a full refund of any amounts paid.


4.2 Pricing and Currency Prices are set in GBP. You can choose to view and pay in a range of local currencies at checkout, where the amount shown is converted at the prevailing rate.


All prices displayed for UK customers are inclusive of VAT at 20%. Shipping charges on UK orders also include VAT at 20%. Our VAT registration number is GB513544413. Orders shipped outside the UK are not subject to UK VAT.


If a pricing error is identified after you have placed an order, we will notify you and give you the option to either confirm or cancel the order at the correct price.


4.3 Payment Methods We accept major debit and credit cards, PayPal, and the digital wallets offered at checkout, which may include Apple Pay, Google Pay and Shop Pay. The payment methods available to you are shown at checkout. By submitting your payment details, you represent that you are authorised to use the payment method and that all information you provide is accurate.


4.4 Payment Security We use secure, PCI-compliant payment gateways. We do not store your full card details.


 


 

5. Shipping and Delivery

5.1 Where We Ship We ship to the United Kingdom, the European Union, the United States, Canada, Australia, New Zealand, and many destinations across Asia, the Middle East and Africa. The destinations available to you, along with delivery options and costs, are shown at checkout.


Delivery timeframes and dispatch times are set out in our Shipping Policy. While we work to deliver on time, delays can occur for reasons outside our control such as customs clearance, weather or carrier disruption.


5.2 Orders Sent as More Than One Parcel We hold stock in more than one location. If your order contains items held in different locations, it may be sent as separate parcels that arrive on different days. You will receive tracking for each parcel and you are only charged once for shipping. Full detail is in our Shipping Policy.


5.3 Delivery Address You are responsible for providing a complete and accurate shipping address. We are not responsible for delayed or misdelivered orders caused by incorrect or incomplete address information.


5.4 Customs, Duties and Import Taxes


  • European Union: orders are shipped Delivered Duties Paid. Import VAT and duties are collected at checkout, so there should be nothing further to pay on arrival.

  • United States: orders are shipped Delivered Duties Paid. All import duties and taxes are covered by us, regardless of order value.

  • All other destinations: your order may be subject to local customs duties or taxes on arrival. These are set by your local authorities, are outside our control, and are your responsibility.


This section mirrors our Shipping Policy. If the two ever differ, the Shipping Policy applies.


 


 

6. Returns and Refunds

Full detail is in our Refund Policy. This section is a summary and does not replace it.


6.1 Your Cancellation Rights (UK and EU) If you are in the UK or EU, you have a legal right to cancel your order within 14 days of receiving it, and a further 14 days to return the goods.


Where you cancel within this period we will refund the full price you paid for the goods plus the original standard delivery charge. If you chose an upgraded or express delivery service, we refund up to the cost of our standard option. No handling fee applies.


You are welcome to inspect the goods as you would in a shop. We may reduce your refund to reflect any loss in value if the goods have been handled more than was necessary to check their nature, characteristics and functioning.


Return postage is your responsibility.


6.2 Returns From Other Countries If you are outside the UK and EU, we accept change-of-mind returns within 14 days of receipt under our Refund Policy. A £3 handling fee is deducted, original shipping is not refunded, and return postage is your responsibility.


6.3 Faulty or Damaged Goods If goods are faulty, damaged or not as described, your statutory rights apply and nothing in these Terms limits them. Under the Consumer Rights Act 2015, UK consumers have a short-term right to reject faulty goods within 30 days of receipt for a full refund, and further rights to repair or replacement after that period.


There is no time limit on reporting a manufacturing fault. Where an item is faulty, damaged or incorrect, we cover the cost of return and put it right at no charge to you, wherever you are.


6.4 Exchanges and Store Credit We do not offer direct exchanges. If you would like a different colourway, return your pair and place a new order.


When you start a return you can choose store credit or a refund to your original payment method. Both options are available on every return, and we will never require you to accept store credit in place of a refund you are entitled to.


6.5 Conditions for Change-of-Mind Returns


  • The product must be in a condition suitable for resale.

  • It must be returned with all original packaging, including the case.

  • Your order number is required as proof of purchase.


6.6 Non-Returnable Items For hygiene and safety reasons we cannot accept change-of-mind returns on goods that have been worn, scratched or damaged. Sale and clearance items are final sale. Neither exclusion applies where goods are faulty.


 


 

7. Product Descriptions and Availability

We make every effort to ensure the accuracy of product descriptions, images and specifications, though colours may vary slightly between screens. Products are subject to availability and we reserve the right to discontinue or change any product at our discretion without notice.


 


 

8. Intellectual Property Rights

All content on the Site, including images, logos, text, graphics and designs, is the property of AIM: Always In Motion Limited and is protected by copyright, trade mark and other intellectual property laws. You may not use our content without our express written consent.


 


 

9. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law. Nothing in these Terms affects your statutory rights as a consumer.


Subject to the above, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or the products purchased, and our total liability is limited to the value of the products purchased.


 


 

10. Indemnification

If you use the Site in the course of a business, you agree to indemnify and hold harmless AIM: Always In Motion Limited, its employees, agents, partners and affiliates from any claims, damages, liabilities and expenses arising from that use or from any violation of these Terms. This clause does not apply to consumers.


 


 

11. Privacy and Data Protection

By using the Site, you agree to our Privacy Policy, which explains how we collect, store and use your personal data. We comply with UK GDPR and the Data Protection Act 2018.


 


 

12. Prohibited Activities

You agree not to:


  • Violate any applicable laws or regulations.

  • Attempt to hack, disrupt or gain unauthorised access to the Site or its systems.

  • Use automated tools or bots to extract data from the Site.

  • Engage in fraudulent activity or misrepresentation.


 


 

13. Termination

We reserve the right to suspend or terminate your access to the Site if we suspect any violation of these Terms or any unlawful activity. Upon termination, all rights granted to you will cease and you must stop using the Site. Termination does not affect any order already accepted or your rights in relation to goods already purchased.


 


 

14. Governing Law

These Terms are governed by the laws of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts. If you are a consumer resident in the EU, you retain the protection of the mandatory consumer laws of your country of residence.


 


 

15. Dispute Resolution

If something goes wrong, please contact us first at info@alwaysinmotion.co.uk and we will do our best to resolve it. If we cannot resolve matters directly, we may agree to use a mediation or arbitration service.

 


 

16. Changes to These Terms

We may amend these Terms at any time. Changes will be posted on this page with an updated Effective Date. By continuing to use the Site after changes are made, you accept the updated Terms. Orders already placed are governed by the Terms in force at the time of the order.
